The National Assembly for Wales has prioritised the need for Dispute Resolution (formerly known as ADR) to be included in the legislation it creates.

The course is designed to give you an overview of the dispute resolution process in Wales and highlights areas where this may differ from England and Scotland. It also uses specific examples within some of the Fields outlined under Part 4, Schedule 7 of the Government of Wales Act 2006. It is essential in ensuring that you are up to date with current public policy in Wales with regard to the use of dispute resolution.

Course Aims

  1. To revisit the general principles of dispute resolution and place with a Wales only context.
  2. To ensure that the participant is appraised of the current policy of the Welsh Assembly Government with regard to dispute resolution in Wales and those affecting public contracts and public services.
  3. The highlighting of how Wales only law is, or may be, diverging from its English counterpart in the area of dispute resolution in matters affected by Part 4, Schedule 7 of the Government of Wales Act 2006 by using general examples of how this is happening.
  4. Assessing the general effect of dispute resolution on both practitioner and client with resulting implications if procedures not adopted.
  5. The use of the specific areas of Planning, Public Procurement Contracts and Education to illustrate to the participant how dispute resolution is now embedded into Welsh only law.

Course Outcomes

  1. Allow the participant to assess the issues of dispute resolution and determine how it will affect their own practice.
  2. To synthesise their own working practices with those now required by the policies adopted by the National Assembly for Wales.
  3. To ensure that knowledge of the area of dispute resolution in Wales is contemporary.
