S.5 of The Government of Wales Act 2006 devolved power in 20 key areas of law to the Welsh Assembly. Following the 'Yes' result in the Referendum of 2011, this has now meant that Part 4 of the Act comes into effect and that Schedule 7 has become operative. This means that the Assembly is wholly responsible for law making in these devolved areas and will have primary law making powers, unfettered by the Westminster Parliament.

The consequences for practitioners who are used to sourcing laws from just Westminster Statutes and the Common Law of England & Wales are fundamental. The new legal order in Wales means that it is now essential that practitioners also source Wales only specific law within the devolved areas. It is no longer possible to offer 'best advice' without doing so. Measures (and post-Referendum, Acts) introduced by the Assembly are examples of primary legislation. Eventually, a growing body of case law will follow. It is essential that practitioners are fully up to date with these new distinct sources of legislation and case law.
